Virginia Legislature Gives CDC, Board of Health Power to Mandate Vaccines for School Children

In the 2020 Legislative session, the Virginia Legislature passed H.B.1090, a bill that amended a law requiring children attending public and private schools in the state to receive vaccines (§ 32.1-46. Immunization of patients against certain diseases).1 Virginia Delegate Patrick Hope (D-Arlington) was the lead sponsor of H.B. 1090 introduced on Jan. 8, 2020, which proposed to automatically mandate that children enrolled in daycare or school receive all current and future vaccines recommended by the federal Advisory Committee on Immunization Practices (ACIP).

The final bill, passed by the Senate in March, granted Governor-appointed members of the Virginia Board of Health the authority to add federally recommended vaccines to the schedule required for school attendance with the exception of the annual influenza vaccination. The bill included an exemption from the requirements of Article 2 of the Administrative Process Act (§ 2.2-4006 et seq. of the Code of Virginia), effectively blocking Virginia citizens and elected legislators from participating in the decision-making process that creates new vaccine mandates for children.

Abdicating Responsibility & Accountability: Eliminating Voters from the Vaccine Law Making Process

Under the U.S. Constitution, duly elected representatives in state legislatures have authority for making public health laws for state residents. In handing the power to make vaccine laws to unelected members of a federal advisory committee and state Board of Health, the Virginia legislature has abdicated responsibility and accountability to constituents by cutting out elected representatives and the voters who elected them from the vaccine law making process.2 Although the new law provides for a 60-day public comment period after the Board of Health issues a Notice of Intended Regulatory Action to add a new vaccine to the required list for daycare and school attendance, the legislature will never again hold a public hearing where citizens can testify for or against the addition of a new vaccine mandate for children.

Under the new law, the state Board of Health composed of physicians and representatives of medical trade and pharmaceutical-related associations like the Medical Society of Virginia, Virginia Pharmacists Association, Virginia Nurses’ Association,3 4 are expected to endorse vaccine use recommendations issued by members of the ACIP appointed by the U.S. Centers for Disease Control and Prevention (CDC). The new law automatically adds up to 10 more doses of five vaccines for daycare and school children, including vaccines that the Virginia legislature previously voted against adding to the schedule, such as the very expensive meningococcal vaccine and HPV vaccine for boys.5

H.B. 1090, as amended, was passed during a special session held by the state legislature on Apr. 22, 2020 during the COVID-19 lockdown. Virginia Governor Ralph Northam, MD signed the bill into law with an effective date of July 1, 2021.6

Strong Public Opposition in Legislative Committee Hearings

H.B. 1090 was first heard in the House Health, Welfare and Institutions Sub-Committee on Jan. 21, when citizens, including parents, grandparents, nurses, doctors and scientists lined up to speak in opposition to the bill. After the committee Chairman announced that the amount of time allocated for all those speaking in opposition to the bill would be limited to 10 minutes in total, the majority of people waiting to testify in opposition to the bill were denied the opportunity to speak. Despite driving and waiting in long lines for hours, Virginia voters were shut out of the law-making process contrary to state legislative policy which states that, meetings of the General Assembly are required by law to be open to the public. Citizen testimony in committee and subcommittee is encouraged.”7

The committee majority placed no time restrictions on those speaking in favor of the bill that would automatically mandate every vaccine the CDC recommends for all children, currently and in the future.

After a limited number of citizens spoke out against the bill, including those who described how their once healthy children regressed into chronic poor health or died after doctors administered CDC recommended vaccines to them, Delegate Dawn Adams (D-68th District), a PhD nurse practitioner stated matter-of-factly:

But I feel like it is also very important to hear this and I know, it’s hard when you are a parent. Vaccinations are for the individual, they are, but they are also for the community and we live in communities. And I understand that sometimes [with] this medical availability [of vaccinations] that we have to do the best job we have for the most people [and this] sometimes results in unintended consequences, and that is a tragedy and [an] across-the-board reality in medical care.

There was an audible gasp in the room after Adam’s remark. It was a slap in the face to every parent who traveled to Richmond that day on behalf of a child who died after vaccination or whose children are suffering every day with vaccine injuries that will never go away. Effectively decreeing that the sacrifice of some children is necessary to implement the proposed new law, the committee members moved on to other bills. However, no one who attended the hearing or watched it that day will forget the cold admission  by those voting for the bill that some children will be harmed by a one-size-fits-all vaccination law that requires parents to choose between risking their children’s lives or giving them a school education.

Limited or No Testimony Allowed

After passing out of the House Health Committee on Jan. 28, the bill moved to the House Appropriations Subcommittee. Testimony was not limited for those in favor of the bill, while those opposed to the bill were again allowed only 10 minutes in total to speak and no testimony was permitted from individuals who had spoken at the first hearing.

As the bill moved through the other committees in the House, testimony was only allowed from supporters of the bill, while those in opposition to the bill were denied the opportunity to speak at all.

On Feb. 10, 2020, HB 1090 was passed by the House of Delegates with a vote of 55 in support and 44 opposed before it moved on to the Senate.8

The Senate Health Subcommittee, which allowed 10 minutes of total testimony in opposition to the bill, was the final opportunity for public to be heard. But the bill was passed by the full Health Committee, Appropriations Committee and full Senate without taking public testimony from any member of the Commonwealth who opposed the bill.

Concerned parents with their children and other concerned citizens attempted to meet with Senators, packing the Senate halls for days, in an effort to voice their opposition to the escalating numbers of vaccines being required for daycare and school. On Mar. 2, 2020, hundreds of protestors rallied in opposition on the Capitol grounds before the bill moved onto the full Senate.

Senators For and Against Bill Debate

The full Senate debated the bill amongst themselves for approximately one hour. There were three amendments proposed and one adopted.

During the debate, retired Naval Officer Senator John Cosgrove (R-District 14) acknowledged that;

We had a lot of people come by our offices, and in the Capital who have been very concerned about what we are doing here. Now let me make this straight to everybody, these people are not crazy. They are not flat- earthers

These people probably know more about these vaccinations than anyone else on this floor and I mean anybody because they studied, they looked at it and they researched it. And some are genuinely frightened for the welfare of their children. For us to be pushing further and further into their parental decisions for their children not our children but their children, I think is a terrible imposition…these are some very intelligent, well educated people. I really hope that we will listen to mothers and fathers and let them decide for themselves and their families how to proceed on this vaccination route.

In contrast, Senator Dick Saslaw (D-35th District) belittled constituents who met with him to express their opposition to the bill;

There were a ton of moms who showed up all with their kids in opposition to it. Those people who spoke in favor of it were a group of various doctors representing various aspects of the medical profession. Let me repeat that, the people supporting this bill are the people who have to deal with these diseases. All of the emails and support I’ve gotten for this have come from doctors over the commonwealth and people who deal with diseases. Well, you say these people know what is best for their kids. In theory that may be right, except for the fact that they are not only putting their own kids in jeopardy but they are putting other people’s kids in jeopardy as well.

Saslaw implied that mothers could not possibly have the knowledge or experience of the experts with medical degrees. Many of the parents prepared to testify in opposition to the bill were doctors, nurses, scientists, lawyers and other college graduates, some of whom witnessed their children regress into chronic poor health after vaccination. However, leaders in control of committees effectively blocked opposing testimony from doctors and other medical professionals. Despite a personal appeal to Senator Lillie Louise Boone Lucas (D-18th District), chair of the Senate Health Committee, two doctors prepared to testify in opposition to the bill were denied the opportunity to speak.

Ultimately, parents of vaccine injured children and those whose children are vulnerable to harm from vaccination were effectively told, again, that even if it is safer for your child not to be vaccinated, you must put your child in harm’s way for “the greater good” in order for your child to receive a school education.

On Mar. 3, 2020, H.B. 1090 narrowly passed the Senate with a vote of 21 in support and 18 opposed.

H.B. 1090 and New Coronavirus Vaccines

The automatic adoption by state public health officials of all new federally recommended vaccines to the required list for children to attend school in the Commonwealth without input from citizens and elected representatives is even more concerning because COVID-19 vaccines are being fast tracked to licensure. While it normally takes 15 to 20 years to develop a vaccine, a vaccine for COVD-19 may be on the market by this September and federally recommended for use by all children and adults in 2021.9

Dr. Dan Barouch, a virologist at Beth Israel Deaconess Medical Center in Boston said;

What people don’t realize is that normally vaccine development takes many years, sometimes decades…and so trying to compress the whole vaccine process into 12 to 18 months is really unheard-of. 10

To create coronavirus vaccines, vaccine manufacturers are using recombinant DNA, messenger RNA (mRNA), nanoparticle and novel adjuvant technology, most of which has never been licensed for use in humans. For example, Moderna, Inc. in partnership with NIAID is developing a COVID-19 vaccine that will inject human cells with mRNA, usually within lipid nanoparticles, to stimulate cells in the body to become manufacturers of viral proteins. Inovio’s DNA vaccine uses electricity to deliver optimized DNA to the cells of the body.11

GSK and Sanofi are also developing an experimental COVID-19 vaccine in collaboration with the U.S. government that will combine GSK’s oil adjuvant AS03 that was included in their H1N1 influenza vaccine, Pandemrix, with the insect cell-based recombinant DNA vaccine technology used by Sanofi Pasteur in their quadrivalent influenza vaccine, FluBlok.12 GSK’s Pandemrix vaccine, which was distributed in Europe during 2009/2010, has been linked to narcolepsy, especially in children.13 14 15

Will an experimental coronavirus vaccine that was rushed to market be mandated for all Virginia school children after the CDC recommends it for every child?

Because a law was passed in 2020 that allows state public health officials to automatically add every CDC recommended vaccine to the list of vaccines required for daycare and school entry—without public hearings or a vote by elected representatives in the legislature—it appears that the answer is “yes.”

    If parents would home school their children, their children would not have to get all these mandated vaccinations. Home schooled children on average attain a significantly higher academic achievement level than children who attend private or public schools. For this reason alone parents should home school their children. But, now with so many states requiring lots of vaccinations for children who attend private or public schools, parents have even more of a reason to educate their children the way Mozart, Beethoven, Ben Franklin and all the other greats of the 18th and 19th Centuries were educated.

      George Jacobson, in Illinois, unfortunately, home schooling doesn’t protect children in this situation. If the religious exemption is removed here (bill introduced Feb 2020), home school children would also be subject to the mandate. Arrgghhh!!!

    All to access public education? That’s the hook that gives them authority. But what good is the educational system if your child is retarded or stifled from vaccinations?

    Obviously we need to grow home schooling in this country, or some other alternative which circumvents the government imposed educational systems. You can’t force something on people, in return for something they don’t want in the first place.

    Sometimes when a dog is rabid and does not listen, you have to put it down.

    The Comrade’s will sooner or later have no need to use ‘school’ as an means to get parents to hand over their children. The law will soon change to include all children and have nothing to do with where they are schooled. If parents do not abide by the new vaccine laws,their children will be vaccinated against their will….by whatever force needed.
    Only the few wealthy ‘elite’ with children will be able to protect their children…..perhaps by purchasing forged or ‘bought’ documents proving that they had their children vaccinated.

    The times they are a changin’.

    This isn’t star-trek and the goal of giving a child a shot in a doctors office isn’t to harm him and protect someone else – it is to protect him. The reality is that big pharma hasn’t done their job investigating vaccine adverse events, which has created the apparent ‘anti-vax’ population of people who are aware of it. More people, including doctors and legislators, need to be standing up to big-pharma and demanding investigations into vaccine adverse events. Accepting that some children become injured by a vaccine is a failure of our society, and anyone who takes up that position should be humiliated and ashamed of themselves.

    That is appalling. I am an R.N. who has personally witnessed severe vaccine reactions. I will NEVER, NEVER, NEVER thank the covid 19 vaccine, nor do I take the annual flu vaccine. I know what is in these vaccines and the potential harm it causes. SHAME on the Virginia legislature. This is not even constitutional!

    I feel so bad for the parents in Virginia. Please keep fighting for your children and your rights. No one should ever make the choice to cause a risk for their child for the greater good of the community. New York families support you. We need to keep fighting.     Adding insult to injury, this occurred in Virginia where the traitorous black-faced Northam has sought to destroy the 2nd Amendment with his draconian anti-guns laws. But hey, you get what you vote for and VA has been heavily democrat being so close to the Swamp.
    We need a Second American Revolution because no one is standing up against this multi-faceted attack on our country. Please don’t waste your time telling me about Trump. He’s failed us too many times now and is only interested in how history books will portray him. By the way I did vote for him the first time around and am not sure about 2020.

    The vaccine injury court has paid out over $4 Billion for vaccine injuries since the 80’s. So don’t tell me these vaccines don’t cause injury and death.
    I suggest a class action lawsuit NOW with an injunction and restraining order

    Legalized injury of the few, in order to protect the many. Sounds like we should have national recognition of this – lower the flag and let the protected pay their respects to the fallen.

    We need to invest more on research into preventing vaccine injury – rather than continue to accept it – which is just the stupidest thing I’ve ever heard.

    Find an attorney and strike the law down. The process was illegal therefore the law is invalid. If the law mandates public access- “voters were shut out of the law-making process contrary to state legislative policy which states that, “meetings of the General Assembly are required by law to be open to the public. Citizen testimony in committee and subcommittee is encouraged.”7

    The evils of fascism. When corporations control the government.

    The people have a duty to resist unjust and unconstitutional laws.

    Some law firm should take this to the federal court. Watch out, this strategy will be attempted now in all the other states

    This is bigger than just Virginia. If we truly believe in our sovereign human right to choose. Then I choose to protect my son from a government who’s end game is literally evil personified. This is a war! A fight to save our children! I will never comply! Guarantee you I will not allow my child to be poisoned by any mandated vaccine. Stand firm in your rights. This will never surrender especially now. I am not asleep. I know what is right and what is wrong. These evil people will be judged by a higher authority than any government. The fact is I am not scared of anyone trying to force me to do anything. My will is stronger than any weapon. You want to try me go ahead. There are certain things other people cannot impose.     Here’s another possible reason for those in control to push vaccines. The vaccine pushers are in league with the ‘population control’ freaks (like Bill Gates) who would love the world’s population to drop to about 3 billion by 2100. Could there possibly be anything in these vaccines which would make having children less probable? Sperm count damage ? I figure if these same folks are thrilled with abortion then population control would be a crowning achievement.

    Dawn Adams’ comment is completely shocking. Even if you could argue that that is the case for a contagious disease that is a threat (and after COVID-19, which of the “vaccine-preventable” diseases is really a threat?!?), how could you legislate this across the board for diseases that can’t be contracted in a classroom setting? HPV for boys? It’s revolting.

    This is a defining moment in history, where we find our liberties and freedoms under serious assault, from a criminally corrupt industry, and the 100% bought and paid for legislators.
    Forced vaccinations with liability free, unwanted medical procedures is an act of violence against our children.
    It’s so bad in the US now, all democrats are responsible for this tyranny. In Colorado, they removed all exemptions, and mandated the flu, HPV, and COVID vaccines to the routine schedule for school. The COVID vaccine does not even exist yet, and they mandated it anyway, that’s how corrupt and criminal these democrats are.
    Yes, I am seriously enraged about this, and prepared to go to war against these fascists, in defense of freedom and liberty from forced medicine.
    I have children and grandchildren, and will NOT stand by and watch them destroyed by a criminal government and industry.
    If we do not stop this NOW, our country and its people are doomed.

    Consider science from sources such as Johns Hopkins School of Medicine, the National Institute of Health and even the pharmaceutical manufacturers’ warning. There is no medical practitioner who will testify that vaccines are without risk; and each must concede that Vaccine Injuries are, in fact, a true reality. The Center for Disease Control (CDC) even has a chart recognizing these injuries in relation to each vaccine.

    No one will disagree that facts matter and that physicians, whether medical, osteopathic, chiropractic, are public servants want what is best for the public at large. With this basic tenet in mind, consider the following.

    A recent Johns Hopkins study claims that more than 250,000 people in the U.S. die every year from medical errors. That would be the equivalent of 3 jumbo jets crashing every 2 days. The 250,000 lives do not include the number people that died from proper protocol, properly performed procedures or properly prescribed medications. That number reflects those that died from errors.

    Science is by definition a fluid process, the evolution of which is riddled with examples of what the scientists of the time thought was proper but turned out to be devastating (ex. thalidomide babies). I submit to you that vaccine injuries are the injury of our time and I beg you to please reconsider your position. That being said medicine is not an exact science.

    Most people that do not vaccinate are educated, knowledgeable and informed. They are doctors, lawyers, scientists, researchers, and CEOs. Most doctors will consider a vaccine injury “unlucky” and all will concede it is truly “a numbers game.” The harsh reality is that this “game” is at the expense of our children and, indeed, an entire generation of minds.

    The science indicates that vaccines and their ingredients can cause autism spectrum disorders, neurological defects, auto-immune disease and psychological disorders.

    That being said, legislators would better serve their constituents if they pushed for safer vaccines, safer vaccination schedules and the elimination vaccines that are unnecessary. That would have a far better impact of the young generation.

    Lastly, nothing will change unless there is some type of campaign finance reform, but that will most likely, never happen. Big pharma has deep pockets and politicians have too much greed.

    Time for all affected and concerned parents to use whatever means possible to file a major class action lawsuit against all state legislators and the governor who supported and passed this tyrannical travesty. There should be enough collective funding available to hire top rated, experienced slate of attorneys to take this one all the way to SCOTUS if necessary!

    There is no scientific evidence for any virus causing any disease. In the highest court of law in Germany, it was proven that the measles virus does not exist. It has never been purified or isolated in all these years. The science is so weak for the argument that viruses cause disease that it has been proven not to be true. Experimental testing of the influenza virus for a contagion found that healthy people could not be infected. In fact, scientists are saying that what are being called coronaviruses are actually exosomes that are produced by our own immune system under stressful conditions. Vaccines are based on antiquated science. The Kennedy 1962 Vaccination Act needs to be repealed. There is no one-size-fits-all approach in medicine. Vaccines were forced on the population only after the vast decline in diseases such as polio yet they claimed vaccines were the only prevention for the disease. It’s nonsense.     I appreciate your comment, thank you for voicing truth. I am a mom and grandparent and hate the way things are changing in this state. A few year ago I had a tetanus shot and thought I was going to die. Obviously I had a serious allergic reaction and there I don’t have any kind of shots after that. I however am at a lose of what I can do and I want to do something. This is constitutionally wrong and I hate how these elected officials are quite. Its not just in Virginia either and as long as one state gets away with it others will follow. We have to speak louder! I just don’t know where to start. If you know where I can please let me know.

    So what are the ethical and moral implications regarding many of the state mandatory vaccination programs forcing parents to inject their children with unavoidably unsafe vaccines? Are the vaccines necessary for the “greater good” and the vaccine injured and dead people expendable and just collateral damage? Do people play Russian roulette not knowing who will get injured or die? Many vaccines turn out to be ineffective, as many diseases vaccinated for afflict the vaccinated. If vaccines are effective, why are multiple shots of the same ones required? So the “greater good” benefit turns out to be false and the vaccine injured and dead people are sacrificed for profit.     What I don’t understand is why do we have all these SO CALLED DOCTORS going to medical school for four years and then residency for three to seven years when all they need is to look this stuff up on Google like I did!     It seems attorneys should all line up to fight for justice and to rid the would-be murderers from coming near us with vaccines. It is every-one’s god-given right to use self-defence, no matter how strongly done, against those that would harm us, our children and animals with medical tyranny!

    Attorneys must go ahead to take to trial, all the Democrat judges who are proving to be imbeciles and traitors. We have to also get them dis-barred!

    Nick, Colorado HB 163 has gone to the governors desk and has not been signed. It seeks to make exemptions more difficult to file and creates a mandatory tracking registry. It does not change the current vaccine schedule or remove exemptions. Please be accurate in your posts to maintain credibility as we all resist the creeping tyrany and erosion of our rights.

This bill was passed like a thief in the night. All during this bs lockdown. He got some anti-gun bills passed too, during this time. This gov pig is a disgrace to Virginia.
