Gardasil Lawsuit Worth  Billion Set for Jury Trial

Merck & Co. is about to face a jury trial defending against a claim that Merck advertisements misrepresented that the Gardasil vaccine was safe and effective. The jury will determine whether the drug giant hid the risks and side effects associated with its lucrative HPV (human papilloma virus) vaccine marketed to children and young adults.1

Merck received more than $8 billion dollars in the last two years from sales of its Gardasil vaccine, which was marketed as a safe and effective prevention of HPV. Plaintiff’s lawyer Mark Lanier, who has previously won multiple million-dollar lawsuits against pharmaceutical companies, warned:

This case has monumental significance to public health and the ways we trust companies who produce vaccines.2

Merck denies the claim and argues:

 At Merck, the safety of our medicines and vaccines and the wellbeing of the people who take them are our top priority. An overwhelming body of scientific evidence, including more than 30 years of research and development along with real world evidence generated by Merck and by independent investigators, continues to support the safety and efficacy profiles of our HPV vaccines. The plaintiff’s allegations have no merit, and we remain committed to vigorously defending against these claims in the upcoming trial.

Plaintiff Lost Normal Life After Getting Gardasil Shots

The plaintiff, Catherine Boss, who lives in Los Angeles, was given her first Gardasil shot she was just 16 years old. The once active teen soon developed postural orthostatic tachycardia syndrome (POTS) among other symptoms. POTS, is a form of dysautonomia that causes the autonomic nervous system to malfunction. The autonomic nervous system controls the majority of the body’s tissues and organs and POTS can cause serious life long health problems.

Boss also experienced fatigue, shortness of breath, hypotension, headache and abdominal pain right after receiving the Gardasil shot. Despite suffering from migraines, vomiting, dizziness, insomnia, severe menstrual cramps, vision loss and panic attacks, Catherine’s doctor gave her the second and third doses of the vaccine over the next year. Unfortunately, Catherine’s symptoms only got worse and she was no longer able to participate in the activities she once enjoyed. Since the Gardasil shots, Catherine has been diagnosed with endometriosis, syncope, dysautonomia, POTS, and a pain disorder.3

Kathleen Boss, plaintiff’s mother, claims that she would never have allowed her daughter to take the controversial HPV vaccine had she been aware of its potential to cause such serious adverse effects on her daughter’s health.4

Merck Knew About & Hid Gardasil’s Serious Adverse Effects

The Complaint alleges that the big pharmaceutical company knew of the Gardasil vaccine’s serious side effects, including death, and made a conscious decision to fail to warn medical providers and the public of these risks. The Complaint also sets forth that Merck was aware of the questionable efficacy of the shot and engaged in a pervasive marketing campaign designed to scare the public into believing the vaccine was necessary in an attempt to guilt and shame parents choosing not to give the shot to their children.

Merck faces claims of failure to warn consumers of the dangers of the Gardasil shot. The allegations also consist of negligence, breach of warranty, common law fraud, violation of California’s unfair competition law and the strict liability claims of failure to warn and manufacturing defect.5

Expert Witness to Testify About DNA Fragments in the Gardasil Vaccine

There have been long-standing allegations that Merck knew that the vaccine was contaminated with HPV DNA fragments. Sin Hang Lee, MD discovered these DNA fragments in 16 Gardasil vials in 2011. Normally, DNA fragments are removed during vaccine production. The DNA fragments were found to be tightly bound to aluminum in the Gardasil vaccine and, when injected, they are absorbed by immune cells triggering pro-inflammatory responses. Dr. Lee has stated that for people with certain genetic variations, Gardasil vaccine could cause autoimmune disorders such as POTS.6

Lee is scheduled to testify as an expert witness in this trial. Newly acquired documents show that Merck’s chief medical officer admitted in an internal email that the drug giant failed to look for contamination of HPVL1 plasmid DNA in the vaccine. Merck scientist, Annie Sturgess, confirmed this damning admission stating, “We have not directly measured HPV DNA.”7

The U.S. Food and Drug Administration (FDA) approved the vaccine without testing for contamination with HPV L1 DNA.8 Accordingly, a victory for the plaintiff could damage the dwindling reputation of the federal agency legally charged with ensuring vaccine safety and already facing concerns over the safety of COVID-19 shots.

Merck’s Pay-Out for Gardasil Harms Could Be Substantial

Because the drug giant’s actions caused a substantial risk to vaccine recipients, the plaintiff may be awarded punitive damages.9 When a plaintiff successfully demonstrates by clear and convincing evidence that a defendant acted with, oppression, fraud or malice” they may be entitled to punitive damages.10 California does not limit the amount of punitive damages that can be awarded. This means that the jury has free reign to set the damages as high as they see fit.11

Stephanie Sherman, another plaintiff attorney, pointed out:

Merck’s efforts to conceal the risk of serious adverse events associated with Gardasil continue to pay off handsomely.  The company knows that disclosing the possibility of life-altering side effects would hurt the bottom line, so the company chose to bury its head in the sand, even as the lives of young men and women are turned upside down after Gardasil. It’s shameful, but it’s also not surprising. Remember, this is the same company that decided Vioxx sales were more important than people. The story is no different with the Gardasil vaccine, and we intend to hold Merck accountable for its disregard for human life.12

Until 2021, Gardasil had the most side effects reported to the FDA’s Vaccine Adverse Event Reporting System (VAERS) since 1990 compared with any other federally recommended vaccine.

    1. When my kids were in school over 15 years ago, here in Wisconsin, I was able to sign a waiver to not get this vaccine. I knew about the harm of this vaccine back then.

  4. My granddaughter has suffered the same symptoms. She was a volleyball player, but because of POTS she was unable to compete during her last high school years to earn a college scholarship. This needs to be a class action suit. She is still suffering. How many other girls are still suffering.

    1. And boys! They push it on boys too! I let one of my sons go to a sports physical alone his senior year, trying to teach him independence. The doctor lied to him and told him he couldn’t play sports without several vaccines. This was one of them. Minors can consent to vaccines and because my son wanted to play sports, he said yes. I blew a gasket when. I found out but of course they denied lying to him. 9 years later I am still furious.

The head of pediatric doctors at the Cedar Mills clinic in Cedarburg Wisconsin insisted that our children get these shots and boosters and was absolutely animated in his insistence that testicular cancer was up 30% and these young teen boys must get this guard Sales shot with boosters he was adamant about it and he insisted on pushing yet This is the same doctor that insisted he could not listen to me (the mother) when I asked him to stop prescribing Adderall for one of my children… insisting it was Safe. He’s a phony and a liar and I know he made money off of pushing vaccines. He conveniently retired in 2017 or 18.

Also, this child abuse detracts from any ability of school districts to actually teach math, English, history, and science. By the way, that ability is so low now, that it’s a joke. 38% math and reading proficiency? Really?! That’s terrible! Double that 38% and it amounts to a D! What’s with these schools? They’re all sex, fake vaccines, teaching kids to disregard their parents, and teaching kids to hate America. Keep the police, and defund the government schools!

  6. My daughter now 28 was given 1 Gardisil shot at 18, I insisted from age 10-18 that it was unnecessary for her she has yet to date. From 18-20 she laid in bed complaining of body aches, went from being extremely petite to heavy, menstrual cycles were messed up and she developed a thyroid goiter and Hashimotos. All within those two years. How do we get involved in this lawsuit?

  7. I have seen 3 young ladies with premature ovarian failure after getting Gardisil. It is my understanding that the committee that studied Gardisil before it was approved recommended to not approve it, due to safety reasons. The head of the CDC (Julie Gerberding) overrode that recommendation and approved it. She then received millions of dollars worth of Merck stock and became head of their vaccine department. Go figure!

  8. My wife died in 2010. While she was still alive I was listening to a talk show on the radio in which her OB physician was the guest speaker. The subject was Gardasil and the physician was promoting the vaccine. It was a call-in show, and I remember a mother calling in and saying that her nineteen-year-old daughter could no longer drive a car since receiving Gardasil. The physician replied, “Did you report that to the drug company?” The mother answered ‘no’. The physician said “That’s why nothing is done about those things”. My impression was that the physician had a conflict of interest in not criticizing the vaccine. She was blaming the mother. A retired physician called in to the program and said that he no longer had an ax to grind and could speak freely. He said there were approximately 5000 cases of cervical cancer a year in the country and that most of the cases occurred in women in the lower socioeconomic strata who were promiscuous and did not seek preventive care. He went on to say that the drug company was promoting the vaccine to millions of middle and upper strata women who were highly unlikely to acquire cervical cancer. Also, my wife’s OB physician was still prescribing Premarin for my wife after a study on Premarin was cancelled because of too many side effects. It is upsetting to learn the role greed plays in the decision making of some physicians.

    1. One of my male relatives and the son of a friend, older men, got throat cancer from HPV. Unlike cervical cancer, it is usually curable. They went through weeks and weeks of a horrible radiation with their heads held still in an uncomfortable brace, couldn’t eat, risked damage to their vocal chords. They would have gladly taken the vaccine, had it been available.

No evidence was ever found by independent researchers that Merck had made any attempt to verify that claim. In fact, it became clear that the shots CAUSED cervical cancer amoung young women & girls which was UNHEARD OF until Merck started pimping the shots to children!!!

  10. This vaccine destroyed my life! I took it back when I was 17. I’m 51 now. I’m dying a slow and very painful death. Stillbirths, excessive bleeding for 17 years that led to hysterectomy and osteoporosis, heart damage, Kidney damage, Pancreatitis, Gerd, IBD, and now I am “developing” blood cancer (Polycythemia Vera).. multiple organs affected. It’s unfair to us that aren’t eligible for this lawsuit because I took it as a teenager. 🤷🏼😡

  11. Reading this article brought back memories of when my daughter’s pediatrician introduced giving her the HPV vaccine when she was just 9 years old! I adamantly refused and she basically said I was a terrible parent denying my daughter a life-saving vaccine…really?? Fast-forward to my daughter’s sports clearance check up (3 years later) and the same pediatrician admitted that she didn’t believe there was enough “research “ and she did not vaccinate her own daughter as a result! Again, really??? So, either her own daughter was more important than mine to not use as a guinea pig to this particular vaccine. This is why I do not trust healthcare and Big Pharma…they are using all of us as their personal experiments…but on their own families there is not enough “research”…smh!!

    1. I was pressured. My daughter was 14. Immediate regret. She’s 16 now, has Dysautonomia/POTS and her symptoms started around the time she got it. She only had the first one. Never got the second or third.

My Son’s pediatrician was always pushing the vaccines and I have remained a strong anti vaxer, (he only got them up to 18 months) she was just about ready to terminate our relationship due to refusal but we moved away, but one thing she did not recommend was the Gardisil, already way back then, 2016 I think, she must have known the damage and terrible consequences it caused teens by getting this vaccine.

  13. I pray they win this!! I lost my 17 year old daughter Paige after her second shot in 2007. She had a massive seizure that lasted at a minimum 45 minutes. 6 days later due to an arachnoid cyst on her brain rupturing from the seizure we lost her. Surgeons kept asking what caused her seizure and what caused the cyst to rupture. We had no idea until other Moms started emailing me telling me it was the shots. Then I asked her doctor and he said it was definitely the shots and he stopped giving them. Still refuses to give them today. My other daughter has a lot of health issues connected to this poison also! She pays for my stupidity daily! Praise God she’s not vaccinating her kids!! She has PCOS and jumps through hoops to have a baby.
